These General Terms and Conditions (“Terms”) govern the access, use, and booking of experiences offered by Taste Perú Tours SAC (“Taste Perú,” “we,” “us”). By booking an activity with Taste Perú, you (“Client” or “Participant”) declare that you have read, understood, and accepted these Terms.


1. Reach

1.1. These Terms apply to all bookings of experiences (food tours, tastings, cooking classes, private experiences or others) made: a) directly with Taste Peru (web, WhatsApp, email, social media or other channels), and/or b) through agencies, hotels or OTAs (for example, GetYourGuide or other platforms).

1.2. If the booking is made through an OTA/third party, additional terms and conditions of that platform may apply. In case of discrepancy, the most favorable condition for the consumer will prevail, unless otherwise provided by law or unless there are specific conditions accepted by the Customer at the time of booking.


2. Definitions

  • Activity/Experience: tourist-gastronomic service offered by Taste Peru.
  • Reservation: confirmation of participation in an Activity for a specific date and time.
  • Private experience: Activity booked exclusively for a group/client (not shared with other participants).
  • No show: failure to appear at the meeting point within the tolerance time.


3. How the contract is formed

3.1. The contract is finalized when Taste Peru confirms the Reservation (by email, WhatsApp, voucher or other proof). 3.2. The Activity is provided according to the confirmed description (duration, inclusions, language, meeting point, etc.), although reasonable adjustments may be made for operational, safety or availability reasons.


4. Requirements for booking and participating

4.1. The Client must provide truthful and complete information (name, contact information, number of participants, dietary restrictions, etc.). 4.2. Some activities may require a minimum age, physical condition, or dress code. These requirements will be communicated before or during the booking process. 4.3. The Client is responsible for communicating allergies, dietary restrictions, and medical conditions in advance. Taste Peru will make reasonable efforts to accommodate, but does not guarantee the complete elimination of all traces or cross-contamination in all cases.


5. Prices, payments and taxes

5.1. The price is provided before payment and includes everything expressly stated as included. Anything not stated is considered not included (e.g., tips, personal purchases, extras). 5.2. Payments can be made by bank transfer, payment link, credit card, or other available methods. 5.3. For private experiences or groups, Taste Peru may require a deposit or full prepayment, as communicated in writing.


6. Punctuality and tolerance time

6.1. The Client must arrive punctually at the meeting point. 6.2. Tolerance time: 10 minutes from the scheduled start time. 6.3. After the tolerance time has passed, and in order not to affect the group's experience and logistics, Taste Peru may: a) start the Activity without the Client; and/or b) consider the situation as a no-show, applying the corresponding cancellation policy.


7. Cancellations and refunds

7.1 Cancellation by the Customer

Due to logistical planning, reservations with suppliers, advance purchase of supplies and staff allocation, Taste Peru applies the following cancellation policy:

  • A 30% cancellation fee is charged if the event is cancelled 5 days or less before the event.
  • A 50% cancellation fee is charged if the event is cancelled 3 days or less before the event.
  • A 100% cancellation fee is charged if the event is cancelled 1 day or less before the event.
  • Cancellations made within 24 hours of the start, late arrival outside the established tolerance time or No Show:❌ No refund will be issued.


7.2 Reprogramming

Rescheduling requests must be made in advance and are subject to operational availability.

  • Requests made more than 48 hours before the start date: may be rescheduled without penalty, subject to availability.
  • Requests made between 48 and 24 hours before the start: may be accepted depending on availability and already committed operating costs.
  • Applications made within the previous 24 hours are not guaranteed and may be rejected.


7.3 How to request changes or cancellations

Applications must be submitted through the official channels:

Indicating:

  • name of the reservation holder,
  • date and time of the experience,
  • name of the experience,
  • number of participants.

The application will be considered valid only when Taste Peru confirms its receipt.


8. Policy for private experiences

Private experiences involve exclusive scheduling, assigned staff, and advance planning; therefore, the following conditions apply:

8.1 Cancellations by the Client (private experiences)

  • A 30% cancellation fee is charged if the event is cancelled 5 days or less before the event.
  • A 50% cancellation fee is charged if the event is cancelled 3 days or less before the event.
  • A 100% cancellation fee is charged if the event is cancelled 1 day or less before the event.
  • Cancellations made within 24 hours of the start, late arrival outside the established tolerance time or No Show:❌ No refund will be issued.


8.2 Rescheduling of private experiences

Rescheduling can be requested more than 48 hours in advance and will be subject to operational availability.

Taste Peru will make reasonable efforts to reschedule the experience; however, availability for specific dates is not guaranteed.


9. Cancellation or changes by Taste Peru

9.1. Taste Peru may cancel or reschedule due to causes beyond its reasonable control (force majeure), including severe weather conditions, government orders, unexpected closures, strikes, riots, security risks, or other circumstances that prevent the provision of the service. 9.2. In the event of cancellation by Taste Peru, the Client may choose: a) reschedule at no cost, or b) a full refund of the amount paid (except for previously informed and accepted non-refundable expenses, if applicable). 9.3. Taste Peru may make non-substantial changes (e.g., adjusting the order of stops or replacing a stop with an equivalent one) without giving rise to a right to a refund, while maintaining the essential value of the experience.


10. Inclusions, exclusions and responsible consumption

10.1. Inclusions are limited to what is stated in the confirmation. 10.2. Alcohol consumption (if applicable) is voluntary and only for adults. Taste Peru may limit or refuse consumption if it considers there to be a risk to the Client or third parties. 10.3. Additional expenses or premium products are charged separately if offered.


11. Participant conduct and right of exclusion

11.1. The Client must respect rules of conduct, hygiene and safety. 11.2. Taste Peru may exclude a participant without refund if:

  • puts your safety or the safety of others at risk,
  • He appears to be in an obvious state of intoxication,
  • engages in offensive, violent, or discriminatory conduct,
  • fails to comply with reasonable instructions from the Taste Peru team.


12. Health, allergies and food responsibility

12.1. The Client understands that kitchens, markets, and restaurants may handle allergens (nuts, shellfish, gluten, dairy, etc.). 12.2. Taste Peru will not be responsible for allergic reactions or adverse effects when:

  • The client did not provide adequate information,
  • unavoidable traces or cross-contamination exist, or
  • The client voluntarily consumes foods against indication.


13. Limitation of liability

13.1. Taste Perú undertakes to provide the service diligently as offered. 13.2. To the maximum extent permitted by law, Taste Perú shall not be liable for indirect damages, lost profits, or unforeseen expenses (e.g., flights, hotels, personal transportation). 13.3. In the event of proven liability, Taste Perú's total liability shall not exceed the amount actually paid by the Client for the specific Reservation that gave rise to the claim, unless otherwise required by mandatory law.


14. Intellectual property and use of images

14.1. The Taste Perú brand and content (texts, photos, designs, materials) are protected by intellectual property rights. 14.2. Taste Perú may take photos or videos during the Activity for archival and marketing purposes. By participating, the Client authorizes the non-exclusive and free use of their image. If the Client does not wish to appear in the photos or videos, they must inform us before the start of the Activity, and we will make reasonable efforts to respect their wishes.


15. Data protection

Taste Perú will process personal data to manage reservations, logistics, customer service, and related communications. This processing will be carried out in accordance with applicable regulations and the current Privacy Policy.

We recommend reporting any issues during the Activity so we can try to resolve them immediately.


17. Force majeure

Taste Peru will not be liable for failures caused by events beyond its reasonable control (force majeure), including natural phenomena, government actions, closures, riots, critical service interruptions, among others.


18. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the competent courts of Lima, Peru, unless otherwise mandated by law applicable to the consumer.


19. Modifications to the terms

Taste Perú may update these Terms. The current version will be the one published on our official channels. Confirmed reservations are governed by the version in effect at the time of confirmation, unless an update is required by law.
